Making a false or fraudulent workers compensation claim is a felony subject to up to 5 years in prison or a fine of up to $50,000 or double the value of the fraud, whichever is greater, or by both imprisonment and fine.

Please remember that both work related injuries and personal injuries have Statutes of Limitations. This means that your claim or lawsuit must be filed with the WCAB within a certain period of time, or the claim will be barred. If a personal injury claim is against a governmental entity, there is a six-month claim statute, which must be satisfied. Personal injury claims have a two year statute in the state of California. This is a separate statute from the governmental entity claim requirement.
