Reported Decisions

The following is a brief list of recent case decisions our firm secured at Trial on Workers’ Compensation Cases.

  • Charles D: Santa Ana, WCAB. Findings and Award July, 2014.
    Judge Richard Brennan. Finding that applicant was 100% totally permanently disabled providing for lifetime payments at the statutory maximum rate of $490.00 per week for applicants date of injury. The present value of the total permanent disability payments is $396,108.00. Applicant was awarded lifetime medical treatment for injuries to his neck, right shoulder, left shoulder, headaches, psyche, heart, hypertension, nausea and gastrointestinal complaints as a result of a specific injury of July 22, 1999.

  • Jose Antonio J: Santa Ana, WCAB. Stipulated Findings and Award 2013.
    Judge Norman Delaterre. The case was highly contested by the defendants until the day of trial. Applicant used Ray Largo as a vocational expert. The defendants stipulated to 100% permanent disability on the day of trial. Applicant suffered from neurological injuries, psychological injuries, psychological and internal injuries as result of his traumatic injury. The present value of the total permanent disability was determined to be approximately $1,700,000.00.

  • Greg W: Santa Ana, WCAB. Findings and Award 2013.
    Judge Agnes Barling. 100% award for injuries sustained to the applicants back, spine, hernia, abdomen, bilateral upper extremities(arms, elbow, wrists), psyche, headaches and urological system. The present value of the future permanent disability payments has been calculated to be in excess of $550,000.

  • David L: WCAB, Riverside Judge David Thorne.
    Compromise and Release in the sum of $150,000.00 for back injuries sustained by applicant. Settlement was approved December 12, 2013.

  • Marie H: Santa Ana, WCAB. Structured Settlement.
    Judge Vincente Blas. Applicant settled her case as part of a structured settlement for $674,010.00. Applicant had injuries to her lower and upper back, shoulders, bilateral upper extremities, headaches, right knee, right lower extremity, internal/gastrointestinal problems and headaches. The settlement date was April 29, 2013.

  • Hugo R: Santa Ana, WCAB. Compromise and Release.
    The applicant settled his back, neck and upper extremity injuries with complaints of depression, sexual dysfunction and digestive problems for the sum of $473,000.00. The C&R was approved by Judge Pamela Pulley January 28, 2013.

  • Elizabeth R: Santa Ana, WCAB. Compromise and Release 2012.
    The applicant settled her back injuries and related injuries for the sum of $120,000.00.

  • Paul K: Santa Ana, WCAB. Findings and Award. July, 2011.
    Judge Agnes Barling. Finding that applicant was 100% totally permanently disabled providing for lifetime payments at the statutory maximum rate of $490.00 per week for applicant’s date of injury. The present value of the total payout s $519,671.00.

  • Alice H: Pomona, WCAB. $500,000.00 Structured Settlement Agreement approved June 7, 2011.

  • Vince M: Santa Ana, WCAB. Stipulation to 100% total permanent disability.
    Approved by Judge Norman Delaterre – September 2, 2010. Applicant to receive $490.00 per week for life, which is the statutory maximum for applicant’s date of injury. The present value of the total payout is $467,508.00.

  • David W: San Bernardino, WCAB. Findings and Award. December, 2009.
    Judge Melanie Schodde. Applicant was found to be 100% disabled for injuries to his head, face, back, bilateral shoulders, lungs, psyche, neck and post traumatic head syndrome. Applicant was awarded total permanent disability with a present value of $1,826,208.00 payable at the rate of $1,069.31 per week for life. Applicant was awarded future medical treatment for the injuries sustained. The case was Appealed by the defendants and their Appeal was denied by the WCAB on March, 2011.

  • Carla I: Santa Ana, WCAB. Findings and Award. June, 2009.
    Judge Leonard J. Silberman. Applicant was found to have sustained 87% permanent disability to applicant’s low back and psyche. She is to receive permanent disability totaling $133,285.00 and a life pension of $104.36 per week thereafter. The total payout was computed at more than $400,000.00. Applicant was awarded future medical treatment for her back and psychological problems.

  • Kendrick P: Santa Ana, WCAB. Findings and Award. December, 2008.
    Judge J. Barry Collins. Finding that applicant sustained 47% permanent disability to applicant’s back and right hand and wrist. The injuries had been denied by the defendants. Applicant was awarded future medical treatment for the injuries sustained.

  • William D: Santa Ana, WCAB. Findings and Award. December, 2008.
    Judge Leonard J. Silberman. Applicant was found to be 100% permanently disabled. Applicant sustained injury to his back, psyche and sustained a sleep disorder. Applicant was awarded permanent total disability for life and reasonably necessary medical treatment for the injuries sustained.

  • Ty H: Riverside, WCAB. Findings and Award. January, 2008.
    Judge Chris Willmon. Finding that applicant sustained 29% permanent disability for injuries that were sustained to the bilateral upper extremities. Applicants injuries had been denied by the insurance carrier.

  • John F: Santa Ana, WCAB. Finding and Award. August 14, 2007.
    Judge Leonard Silberman. Finding that applicant sustained 78% permanent disability to applicant’s low back, left leg, neck, psyche and headaches. Applicant was awarded $129,562.00 in permanent disability plus a life pension of $69.58 per week thereafter. Applicant was awarded future medical treatment for the injuries sustained. The case settled based on a structured settlement with a present value of $331,000.00 in June 2011.

  • Lori J: Santa Ana, WCAB. Findings and Award. August, 2007.
    Judge Agnes T. Barling. Finding that applicant sustained 62 ½% permanent disability to applicant’s back, bilateral knees and psyche. There was a companion finding that applicant had sustained 34% permanent disability for a separate injury involving the same body parts. Applicant was awarded future medical treatment for the injuries sustained and permanent disability according the Labor Code.

  • Frank F: Santa Ana, WCAB. Findings and Award. February, 2007.
    Judge J. Barry Collins. Finding that applicant sustained 63% permanent disability to applicant’s bilateral hips and left wrist.

  • Gloria C: Santa Ana, WCAB. Findings and Award. Judge Pamela Stone.
    Finding that applicant sustained 72% permanent disability to applicant’s lumbar spine, neck, bilateral upper extremities, right arm, right lower extremity and headaches. Applicant was Awarded permanent total disability of $73,422.21 plus a life pension of $46.38 per week payable for life after payment of the permanent disability. Applicant was awarded future medical treatment for the injuries sustained.

  • Mary K: Santa Ana, WCAB. Judge Rosa Lim. 74% Stipulation for injuries sustained to applicant’s back, neck internal organs, and gastrointestinal complaints related to her injuries. Applicant is entitled to future medical treatment for the injuries sustained.

  • Tara P: Santa Ana, WCAB. Findings and Award. October, 2005.
    Judge Agnes Barling. Finding that applicant sustained 84% permanent disability providing for a total payment of $127,075.00 and a life pension payable thereafter at $92.77 per week for life.

  • Richard A:Santa Ana, WCAB. Findings and Award. August, 2005.
    Judge Marilyn Casey. Finding that applicant sustained 93% permanent disability to applicant’s neck, back, bilateral upper extremities and bilateral lower extremities and psychiatric injury. Applicant was awarded $145,705.00 for permanent disability and a life pension of $127.56 per week for life after payment of the permanent disability. Applicant was awarded future medical treatment for the injuries sustained.

  • Rhonda F: Santa Ana, WCAB. Findings and Award. June, 2005.
    Judge Norman Delaterre. Finding that applicant sustained 100% permanent disability for both orthopedic and psychiatric injuries. Applicant had filed a Petition for Reconsideration which was granted by the Appellate level of the WCAB, which issued a Decision that applicant had sustained total permanent disability for applicant’s orthopedic and psychiatric injuries and would receive permanent disability for life as well as future medical treatment for injuries sustained to her back, bilateral legs and psyche.

  • Richard S:Santa Ana, WCAB. Findings and Award. April, 2005.
    Judge Robert E. Drakulich. Finding that applicant sustained 59% permanent disability to applicant’s right hand and psyche. Applicant was awarded future medical treatment for the injuries sustained.

  • David C: Anaheim, WCAB. Findings and Award. November 2004.
    Judge Allen Skelly. Findings that the applicant sustained 100% permanent disability for injuries to applicant’s left lower extremities, left clavicle, ribs, pelvis, spine, spleen, peripheral vascular disease. Applicant is receiving total permanent disability for life, plus reasonably necessary future medical treatment for the industrial injuries.

  • Bruce A: Santa Ana, WCAB. Findings and Award. June, 2004.
    Judge Pamela Stone. Finding that the applicant sustained 100% permanent disability to applicant’s head, neurological systems, upper extremities, lower extremities, psyche, back, spine. Applicant is to receive total permanent disability for life at the maximum permanent disability rate for injuries sustained. Applicant was awarded further medical treatment for the injuries sustained.

  • Diana R: Santa Ana, WCAB. Judge Sallie Doyle. March, 2003.
    Award for 76% permanent disability. Applicant was found to have sustained permanent disability to applicant’s bilateral upper extremities, bilateral lower extremities, neck, head, back, and psyche. Applicant was awarded $110,515.00 in permanent disability and a life pension thereafter of $61.85 per week for life.

  • Nan G:Santa Ana, WCAB. Finding and Award. November, 2002.
    Judge Sallie Doyle. Finding that applicant sustained 100% permanent disability to applicant’s ribs and spine. Applicant was awarded total permanent disability for life and future medical treatment for the injuries sustained.

  • Pracash R: Anaheim,WCAB. Findings and Award. April, 2000.
    Judge Nancy Gordan. Finding that applicant sustained 48 ½% permanent disability to her bilateral arms and psyche. The injuries were denied by the defendants.

  • Carmen H: Santa Ana, WCAB. Stipulations with Request for Award. November, 1999.
    Judge Joanne Coane. Applicant was found to have sustained 100% permanent disability to applicants head. Applicant was awarded total permanent disability for life and future medical treatment for the injuries sustained.

  • Maria R: Santa Ana, WCAB. Findings and Award. December, 1998.
    Judge Shelly Bodnar. Applicant was found to have sustained 100% permanent disability for applicant’s upper extremity and psyche. Applicant was awarded total permanent disability payable for life plus future medical treatment for the injuries sustained.

  • Barbara M: Santa Ana, WCAB. Findings and Award. May, 1996.
    Judge Kirner. Finding 100% permanent disability to applicant’s back and psyche. Applicant was awarded total permanent disability payments for life. Applicant was awarded future medical treatment for the injuries sustained.
